Inter-Caste Marriage — Safe, Legal & Confidential

Inter-caste and inter-religion marriages in India are fully legal under the Special Marriage Act, 1954 (SMA) — whether you are a Hindu-Muslim, Hindu-Christian, Sikh-Jain, or any inter-caste combination. The law is firmly on your side. In reality, however, family opposition, social pressure, and safety concerns are common issues. This is exactly where our team has been helping hundreds of inter-caste couples in Delhi for over 9 years.

For just ₹6,100 (at Rohini Court Sec-14, near Sector-18 Metro), we handle the complete Special Marriage Act registration — including document drafting, notice filing, affidavits, and certificate collection. If your case is complicated (family threats, legal notices, or risk of abduction), we also guide you on police protection petitions and safe-house arrangements.

Special Marriage Act 1954 — Your Legal Right

The Special Marriage Act (SMA) is India's secular marriage law — religion, caste, and community do not matter. A Hindu man can marry a Muslim woman, a Brahmin woman can marry a Dalit man, and an Indian can marry a foreign national — all under the SMA without any need to change religion.

The Supreme Court has repeatedly confirmed (Lata Singh v. State of UP, 2006; Shakti Vahini v. Union of India, 2018) that adult couples have a constitutional right to choose their own life partners under Article 21. No family, khap panchayat, or community group can force you otherwise. If anyone threatens you, it is the duty of the police to provide protection.

Delhi High Court Guidelines

The Delhi High Court has issued specific guidelines for inter-caste couples. Our team conducts the SMA registration in line with these guidelines and, where required, files an application for police protection. The Delhi Commissioner of Police also operates a dedicated Special Cell for Women & Couples that assists couples in distress.

Eligibility — Inter-Caste / Inter-Religion Marriage

Eligibility under the SMA is simple — there are no restrictions of religion:

  • Age — Groom 21+ years, Bride 18+ years
  • Mental soundness — both partners must be mentally capable of giving valid consent
  • Both must be single — any previous marriage must be legally ended (through divorce or death)
  • Not within prohibited degrees of relationship (close blood relations)
  • At least one partner must have resided in Delhi for 30 days or more
  • No religion conversion is required — both partners can retain their respective religions

Common Scenarios — How We Help You

Scenario 1 — Family Opposition (Most Common)

If your family is opposed to the marriage but is not making direct threats, the simplest route is the Special Marriage Act registration. The 30-day notice is filed at Rohini Court (not at your home address), and the marriage is registered on the 31st day. The couple receives a legal certificate, after which any future family opposition no longer matters legally.

Scenario 2 — Time Constraint (No 30-Day Wait)

If the couple wants to be married the same day without waiting for the notice period, we suggest the Arya Samaj route (if both are Hindu) or an immediate Hindu religious ceremony followed by marriage registration. This is available between ₹3,100 and ₹6,100. For inter-religion couples this option is limited — a consultation is essential.

Scenario 3 — Active Threats or Safety Issues

If the family has issued threats or the couple is unsafe, we can file an emergency police protection petition in the Delhi High Court through senior advocates. In such cases, the petition and court fees are charged separately from the base SMA fees, with a transparent estimate provided upfront.

Scenario 4 — NRI or Foreign Partner

If one partner is an NRI or a foreigner, marriage under the SMA is fully possible. We will guide you on the foreigner's Single Status Certificate, passport, visa, and embassy No Objection Certificate. NRI Nikah and the NRI package are also available.

Every case is unique. Discuss your case with us in 5 minutes on the phone — you will receive a personalised solution.

Required Documents — Inter-Caste / SMA

Documents Checklist (Both Partners)

  • Aadhaar Card (original + photocopy)
  • Age proof — Class 10 marksheet, birth certificate, or passport
  • 6 passport-size photographs (each)
  • Delhi residence proof — Aadhaar, rent agreement, or electricity bill
  • Affidavits — marital status, age, and nationality (drafted by us)
  • 3 witnesses with their Aadhaar — to be brought by the couple (typically a family member or close friend)
  • For divorcees or widows — divorce decree or death certificate
  • For foreigners or NRIs — passport, visa, and Single Status Certificate from the embassy

How is Police Protection Obtained?

According to the guidelines of the Delhi High Court and the Supreme Court — if a couple is concerned about their safety, a writ petition can be filed in the High Court under Section 482 CrPC. The court can order Delhi Police to provide protection to the couple and restrain any family member or third party from interfering.

Senior advocates associated with our team can file this petition for you. The order is normally received within 24 to 72 hours. In addition, a complaint can be filed at the Delhi Police Special Cell for Women & Couples (1091 / 112). Contact us — emergency cases receive immediate response.

Frequently Asked Questions — Inter-Caste Marriage

Is the 30-day notice sent to the family's home?
No — we publish the notice on the notice board at Rohini Court Sec-14. No public notice is sent to your home address. If you want to avoid the 30-day wait altogether, the Arya Samaj route (if both partners are Hindu) is an alternative.
Is religious conversion required?
No. Under the Special Marriage Act, both partners can retain their own religions. This is the SMA's biggest strength — which is why it is the safest route for inter-religion couples.
How quickly can police protection be granted?
In genuine threat cases, a High Court protection order is typically obtained within 24 to 72 hours. Contact us directly — same-day filing is possible for emergency cases.
What is the total cost?
A simple SMA registration is ₹6,100. For police petition or protection cases, court fees and senior advocate charges are billed separately — a transparent estimate is provided on the pricing page or over the phone.
One partner is a foreign citizen — is the marriage possible?
Yes. An Indian-foreigner marriage is fully valid under the SMA. The foreign partner needs to provide some extra documents (passport, visa, embassy NOC). We guide you through the complete process — see our special NRI package here.
